About ALEC |

ALEC is a corporate bill mill. It is not just a lobby or a front group; it is much more powerful than that. Through ALEC, corporations hand state legislators their wishlists to benefit their bottom line. Corporations fund almost all of ALEC's operations. They pay for a seat on ALEC task forces where corporate lobbyists and special interest reps vote with elected officials to approve “model” bills. The American Legislative Exchange Council (ALEC) has nine task forces:
- the ALEC Civil Justice Task Force,
- the ALEC Commerce, Insurance and Economic Development Task Force,
- the ALEC Communications and Technology Task Force,
- the ALEC Criminal Justice Reform Task Force,
- the ALEC Education and Workforce Development Task Force,
- the ALEC Energy, Environment and Agriculture Task Force,
- the ALEC Federalism and International Relations Task Force,
- the ALEC Health and Human Services Task Force, and
- the ALEC Tax and Fiscal Policy Task Force.
(Until it was disbanded in April 2012, ALEC also operated a Public Safety and Elections Task Force, which adopted such "model" bills as the "Stand Your Ground" bill or "Castle Law" doctrine and the voter ID Act. Later in 2012, ALEC launched the "Justice Performance Project" (JPP) in place of the Public Safety and Elections Task Force. The bills associated with the JPP in task force materials obtained by the Center for Media and Democracy and posted by ALEC appear to continue ALEC's modus operandi of promoting the financial interests of the corporations and special interest groups that fund it, such as the American Bail Coalition, according to PRWatch.[1])
This article is about ALEC's Commerce, Insurance, and Economic Development Task Force. Legislators can join this task force for no extra cost. 2013 Annual Meeting Substantive Agenda
The following "model" bills were proposed at the Chicago, IL conference:
- Amendments to ALEC "Occupational Licensing Relief and Job Creation Act" (this act "protects against the use of occupational regulations to reduce competition and increase prices to consumers. When enacting future occupational regulations, this Act requires state legislatures to find real harm, and select the least restrictive regulation to address that harm. The Act also protects entrepreneurs by shifting the burden to the government to show in court and administrative hearings that it is enforcing occupational laws for health-and-safety reasons, and not solely as a barrier to entry.")
- "Temporary Help Unemployment Insurance Act" (This Act "requires, as a condition of unemployment benefit eligibility, that temporary employees contact their temporary help employer for new work upon completion of their temporary assignment. The Act also requires that temporary employees be informed of this requirement.")[12]

- "An Act Providing for the Detection and Prevention of Fraud, Waste, Abuse and Improper Payments in State Government" (presented by Ms. Petra Smeltzer, National Association of Water Companies) (This proposal "would improve government efficiency and accountability by detecting and preventing fraud, waste, abuse and improper payments in state government," by establishing "an Enterprise Fraud Program Office with the authority to develop and implement an automated fraud detection system across state agencies.")

Glenn Vaad of Colorado and Mr. Emory Wilkerson, State Farm Insurance) (This proposal "supports the elimination of federal restrictions on state tolling to give states maximum flexibility to meet their transportation needs.")[13]
2012 ALEC Spring Task Force Summit Substantive Agenda
At the May 2012 ALEC Spring Task Force Summit in Charlotte, North Carolina, the Commerce, Insurance and Economic Development Task Force "voted to launch a Special Advisory Subcommittee for the Review of Model Policies. The subcommittee will provide recommendations on pieces of model legislation that may be in need of update."
The following model bills were adopted at Charlotte and then were sent on to the ALEC board for approval:
- "Resolution Opposing Federal Regulation to Extend Unemployment Insurance Benefits to New Parents" (The introduced resolution is on file with CMD. It "identifies serious problems" with the Birth and Adoption Unemployment Compensation Rule that permits workers with newborn or newly adopted children to collect unemployment insurance benefits while on leave.")
- "The Tenant Management Act" (The introduced resolution is on file with CMD. It "allows housing authorities to contract with tenant management organizations for the operation and management of housing projects.")
- "Affordable Housing Construction Stimulation Act" (The introduced resolution is on file with CMD. It "allows certain requirements a developer must meet under a municipal housing or building code to be waived.")
- "Resolution Opposing Federal Legislation to Repeal or Modify the McCarran-Ferguson Act" (The introduced resolution is on file with CMD. The act opposes federal legislation to repeal the McCarran-Ferguson Act which "provides a limited insurance exemption from federal anti-trust laws in order to ensure the viability a healthy, competitive insurance market...")
- "Full Employment Act" (The introduced resolution is on file with CMD. It "suspends normal benefits of the AFDC, Unemployment Insurance, and Food Stamp programs, except for those Food Stamp recipients who are aged, blind or disabled.")
- "Proposed Resolution Opposing OSHA's Proposed Ergonomics Work Restriction Protection Plan" (The introduced resolution is on file with CMD. It opposes OSHA's proposed Ergonomics Work Restriction Protection Plan which would "require an employer to pay a worker on modified duty at least 100 percent of pre-injury after-tax earnings for a worker unable to do any job...")
- "Resolution Opposing Ergonomic Regulations Based on Unsound Science" (It opposed Ergonomic Regulations which "reduce back, arm, neck and other musculoskeletal strains and aches often referred to as "repetitive stress injuries" (RSI's) because "ergonomic regulations should should not be mandated until such regulations are proven to actually reduce or prevent RSI's by sound scientific evidence.")[14]
2011 ALEC Winter Task Force Summit Substantive Agenda

- "Resolution on the Misapplication of Employee Classification Laws" (presented by Mr. Troy Flanagan, International Franchise Association) (This proposal "recognizes that business format franchising is a major contributor to the United States economy. The resolution also recognizes that franchising is a contractual business relationship, not akin to an employment relationship.")
- "Resolution to Restore Transportation to the States" (presented by Dr. Adrian Moore, Reason Foundation) (This proposal "empowers the state of [insert state] to manage gas tax dollars without federal government interference.")
- "Resolution in Support of Payroll Cards" (Presented by Ms. Kate Viar, VISA) (This proposal "opposes recent efforts to over-regulate payroll card laws, such as unreasonable mandates on employers to provide programs that require free banking services which will ultimately increase the cost of payroll card provision, reduce the likelihood of their use, and consequently, their benefits.")
- "Competitive Private Professional Certification Act" (Presented by Rep. Tom Forese of Arizona) (This proposes "private certification enforced by criminal law," of "professionals".)[15]
2011 ALEC Summer Task Force Summit Substantive Agenda

- "Establishing a Public-Private Partnership Authority Act" (Presented by Geoff Segal, Macquarie Capital USA) (This proposal "establishes a state Partnership Committee and an Office of Public-Private Partnerships to identify and establish public-private partnerships and approve qualified bidders, requests for proposals, and template contracts.")
- "Resolution in Support of a National Infrastructure Bank" (Presented by Geoff Segal, Macquarie Capital USA) (This proposal "supports the establishment of a National Infrastructure Bank in order to provide credit assistance and encourage investment in infrastructure.")
- "Multiple Award Schedule Contracts Act" (Presented by Thom Iles, John Deere & Company) (This proposal "requires state contracts to be awarded via Multiple Award Schedule (MAS) contracts. MAS contracts provide state agencies the freedom to evaluate vendors based upon a variety of factors including: discounts, total life cycle costs, service, warranty, distribution channels, and past vendor performance.")
- "Long Term Asset Management Act" (Presented by Butch Eley, Association for Management and Operations of Transportation Infrastructure Assets (AMOTIA)) (This proposal "encourages the state Department of Transportation to develop and implement long-term asset management strategies and programs for all transportation infrastructure assets.")[16]
2011 ALEC Annual Meeting Substantive Agenda
From the 2011 ALEC Annual Meeting Program: "A few of the issues that the Task Force will be considering at Annual Meeting include: public-private partnerships, a national infrastructure bank, long-term asset management, and multiple award schedule contracts. The Task Force will also consider amendments to a current ALEC policy on franchise agreements...the Task Force meeting will (also) host a panel on effective privatization: 'Tapping the Private Sector to Save Money and Improve Performance.'"[17]

State Farm Mutual Automobile Insurance Company is the largest seller of auto insurance in the U.S. It also sells property/casualty, home and life insurance. State Farm is also in the banking business with State Farm Bank offering financial products through State Farm agents, according to its Hoovers profile.[23] It had a net income in 2010 of $1.8 billion, up from $777 million in 2009.[24] Its CEO, Ed Rust, made $10.2 million in the same year.[25] State Farm gave a combined total of $4.1 million in federal and state political contributions in 2008.[26]

"Alldredge directs state legislative and strategic state advocacy activities for NAMIC in all 50 states. In addition, Mr. Alldredge represents NAMIC member companies at the National Conference of Insurance Legislators (NCOIL) and the National Conference of State Legislatures (NCSL); . . . and on the board of the Insurance Education Council. Mr. Alldredge is also the lead representative on the insurance scoring issue for NAMIC member companies. He participated in the drafting of the NCOIL model law and has provided testimony to legislatures in several states and at the NAIC.
"Before joining NAMIC, Mr. Alldredge spent five years with the Indiana state Senate, where he served in a dual role as director of planning and research and executive director of the Senate Majority Campaign Committee."[29]

- Ed Conklin (Senior Director of government relations for McDonald's), Chairman[29] - McDonald's announced it would end its ALEC membership, and therefore its CIED Task Force membership, April 10, 2012.[30]
Conklin lobbies in "the U.S and the Caribbean. He also helps develop government relations capacities in Brazil. Ed’s duties include direct lobbying, managing contract lobbyists, developing and guiding coalitions, representing the system’s public policy interests in trade groups, managing McDonald’s owner/operator state PACs, maintaining ongoing communications with McDonald’s U.S. headquarters offices, division, and regional offices, and owner/perators, and developing and managing strategic plans and budgets. In addition, he is responsible for the development, training, and activation of McDonald’s grassroots owner/operator network."
Before joining McDonald's in 1992, Conklin worked for ten years as Director of Public Affairs for Jones Intercable’s Midwestern operations and Operations Manager and Director of Marketing for the company.
Conklin is a member of the Council of State Governments and the State Government Affairs Council. He also works closely with the leadership of the International Franchise Association, GMA, the National Restaurant Association, the National Council of Chain Restaurants and its state affiliates, and the National Retail Federation.[29]
Primeaux is registered as a lobbyist for FedEx in New York City,[32] the state of Texas,[33] and in Louisiana prior to December 31, 2009.[34]

Before joining the ATA, Scott was Director of Government Relations for Roadway Express and YRC Worldwide. He has also been Director of Highway Operations at the ATA.
